Terms of Use.

Insted (Pty) Ltd ("Insted", "we", "our", "us") (Registration No: 2026/183553/07) is a technology platform that enables customers to place and pay for orders at participating venues and events.

Insted facilitates ordering and payment processing but does not prepare, sell, or supply any food or beverages.

The venue or event operator ("Venue") is the merchant and supplier of all products ordered through the platform.

By using the platform, you confirm that the information you provide is accurate and complete.

Insted does not verify the age of users. The Venue is solely responsible for verifying age upon collection where age-restricted goods such as alcohol are involved. Insted accepts no responsibility for age verification and shall not be liable for any failure by a Venue to comply with applicable age restriction laws.

No account is required to place an order. You only provide your phone number so we can notify you when your order is ready for collection.

• Scan a QR code or access the Insted ordering page at your event or venue
• Select your items and complete payment
• Once payment is successful, your order is submitted to the Venue
• You will receive an order confirmation and a pickup code via SMS
• Present your pickup code to collect your order

Orders are only confirmed once payment has been successfully processed.

All payments are processed securely through a third-party payment gateway in South African Rand (ZAR). Insted does not store your card details.

By placing an order, you authorise the total amount displayed at checkout to be charged to your selected payment method, including any applicable service fees.

If payment fails, the order will not be processed.

• Orders cannot be amended once submitted
• You are responsible for collecting your order using the correct pickup code
• The Venue may refuse collection if the pickup code is not presented
• The Venue may refuse service if required by law, for example due to intoxication or failure to provide valid identification

Insted is not responsible for delays caused by the Venue.

Refunds may be issued in the following circumstances:

• Payment was processed but the order was not provided
• A duplicate payment occurred
• A verified system error occurred

Refunds will not be issued if you fail to collect your order, change your mind, the event ends before collection, or the Venue refuses service due to intoxication or failure to provide valid identification.

Approved refunds will be processed to the original payment method within a reasonable period.

All items are subject to availability. If an item is unavailable after payment, the Venue may offer a replacement or authorise a refund. Insted is not responsible for stock shortages.

Alcohol is supplied by the Venue. The Venue is solely responsible for compliance with liquor licensing laws, age verification, and responsible service of alcohol. Insted does not assume responsibility for alcohol consumption or related consequences.

You agree to use Insted in compliance with all applicable South African laws. Insted reserves the right to cancel suspicious or fraudulent orders, refuse access to the platform, and investigate abuse or misuse.

Providing false information or attempting fraudulent transactions may result in legal action.

Insted provides a technology platform only. To the fullest extent permitted by law:

• Insted is not responsible for the quality, preparation, safety, or legality of products supplied by the Venue
• Insted is not responsible for alcohol-related harm, injury, or loss
• Insted is not responsible for delays caused by the Venue, connectivity issues, or force majeure events

Insted's total liability, if any, is limited to the value of the transaction in question.

Your personal information is processed in accordance with our Privacy Policy and the Protection of Personal Information Act (POPI Act). By using the platform, you consent to the collection and use of your phone number for order notification purposes only.

All content, branding, and technology on the Insted platform is owned by Insted (Pty) Ltd. You may not copy, reproduce, or distribute any part of the platform without our prior written consent.

Insted does not guarantee uninterrupted availability of the platform. We may suspend or modify the service at any time for maintenance, upgrades, or operational reasons. We are not liable for any loss or inconvenience arising from service interruptions.

We reserve the right to update these Terms at any time. Continued use of the platform following any changes constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of South Africa. Any disputes shall be subject to the jurisdiction of South African courts.
